TERMS OF USE

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Crefftus, a trading name of Siop y Pethe Cyf, the company responsible for billing and payments ("Crefftus", "we", "us", or "our"), concerning your access to and use of the Crefftus online marketplace website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. Crefftus reserves the right, in its sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Use. It is your responsibility to periodically review these Terms of Use to stay informed of updates. Your continued use of the Site will be deemed acceptance of any revised Terms.

The Site is intended for users who are at least 18 years of age and who reside in the United Kingdom. Users accessing the Site from outside the UK are responsible for compliance with local laws. The Site acts as an online marketplace where independent sellers ("Sellers") can list and sell handmade, artisan, vintage or other permitted products to buyers ("Buyers"). Crefftus does not manufacture or inspect any of the products sold through the Site and acts solely as an intermediary platform.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is the proprietary property of Crefftus and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by Crefftus or licensed to Crefftus. The Content and the Marks are provided on the Site "AS IS" for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without the express prior written permission of Crefftus.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. Crefftus reserves all rights not expressly granted to you in and to the Site, the Content and the Marks.

USER REPRESENTATIONS

By using the Site, you represent and warrant that: (1) you have the legal capacity and agree to comply with these Terms of Use; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the Site through automated or non-human means; (4) you will not use the Site for any illegal or unauthorized purpose; and (5) your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, Crefftus has the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

SELLER TERMS

Sellers must ensure all items listed for sale comply with applicable UK laws and these Terms of Use. Sellers are responsible for setting their prices, fulfilling orders, shipping goods in a timely manner, and dealing with returns in accordance with applicable consumer protection legislation, including the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.

PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which Crefftus makes it available. The Site may not be used in connection with any commercial endeavors except those specifically endorsed or approved by Crefftus.

USER GENERATED CONTRIBUTIONS

CONTRIBUTION LICENSE

You and the Site agree that Crefftus may access, store, process, and use any information and personal data you provide in accordance with the Privacy Policy and your choices.

By submitting feedback or suggestions, you agree that Crefftus can use and share such feedback for any purpose without compensation to you.

SUBMISSIONS

Any questions, comments, suggestions, ideas, or other information regarding the Site provided by you to Crefftus are non-confidential and shall become the sole property of Crefftus. Crefftus shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose.

SITE MANAGEMENT

Crefftus reserves the right to: (1) monitor the Site for violations of these Terms of Use; (2) take legal action against violators; (3) restrict access or disable any Contributions; (4) remove excessive or burdensome content; and (5) otherwise manage the Site.

TERM AND TERMINATION

These Terms remain in effect while you use the Site. Crefftus may deny access, terminate use, or delete content at any time, with or without notice.

MODIFICATIONS AND INTERRUPTIONS

Crefftus reserves the right to change or discontinue the Site at any time, without notice. We are not liable for any downtime or disruptions.

GOVERNING LAW

These Terms shall be governed by and defined in accordance with the laws of the United Kingdom. You consent to the exclusive jurisdiction of the courts of the United Kingdom.

DISPUTE RESOLUTION

Binding Arbitration: Any dispute shall be referred to and finally resolved by the International Commercial Arbitration Court under the European Arbitration Chamber in Brussels. The number of arbitrators shall be one (1). The seat of arbitration shall be London, United Kingdom. The language shall be English. The governing law shall be the substantive law of the United Kingdom.

LIMITATIONS OF LIABILITY

In no event shall Crefftus or its agents be liable to you for indirect, incidental, special, or punitive damages. Liability is limited to the lesser of the amount paid by you or £100.00.

INDEMNIFICATION

You agree to indemnify and hold harmless Crefftus, its affiliates, officers, and employees from any loss or claim arising from your use of the Site or breach of these Terms.

USER DATA

Crefftus may retain and use data transmitted to the Site. You waive any claims regarding loss or corruption of data.

ELECTRONIC COMMUNICATIONS

You consent to receive communications electronically. You agree that contracts, notices, and disclosures provided electronically satisfy any legal requirement for written documents.

MISCELLANEOUS

These Terms constitute the entire agreement between you and Crefftus. If any part is unlawful, it shall not affect the validity of the remaining provisions. You waive any defenses based on electronic form and lack of signature.
